CONTRACT AND AGREEMENT of adopting a puppy

The purpose of this agreement is to provide a mutual understanding of the scope and responsibility of adoption, and provides protection for the breeder and buyer.

Buyer understands that the puppy purchased can be a fragile breed. Furthermore, buyer understands additional care will be needed to ensure health and well-being of said puppy.

Deposit:

A deposit of $300 is required upon picking a puppy or being added to the waitlist. You are committing to a puppy, so the deposit is nonrefundable unless:

1. Unforeseen circumstances arise and you cannot care for the chosen puppy. The deposit can be rolled to a future litter. I MUST be notified by the time the puppy is 6 weeks. After 6 weeks, you have forfeited your deposit. 
    

2. Any genetic defects (ex: heart, eyes) are found at the vet check. If this is the case with said puppy, your $300 deposit is refunded immediately unless you chose to roll deposit for first choice on next litter.
    

Purchase: The final balance is due after vet clearance and upon placement of puppy. Travel expenses are at buyer’s expense. NO CHECKS 

 

Health:

Seller states the puppy you are purchasing is healthy at the time of sale. For purpose of this agreement, once puppy leaves the seller’s premises, it is under the buyer’s control. Notice of any problem with said puppy must be received within 72 hours in the manner described below.

 

1. Seller will have the puppy examined by a veterinarian prior to placement. The Buyer may also have a veterinarian examination done by their own veterinarian. If the buyer feels that there is an issue with the puppy upon arrival, the buyer must have the puppy examined within the first 72 hours (internal, external parasites, kennel cough or hypoglycemia excluded) Seller reserves the right to have puppy examined by a veterinarian of seller’s choice, before exchange is made.

2. Puppy is guaranteed for 72 hours from date and time of purchase against infectious diseases such as Parvo, Corona, or Distemper.

3. Puppy is guaranteed for 1 year from the date of purchase against genetic defects.

4. All veterinarian expenses are responsibility of pet owner.

5. Umbilical Hernias are very common in Cavalier adults and puppies. If at the time of sale of the puppy it has a hernia no larger than a walnut then it is unlikely to experience any problem.  There is a natural opening in the abdominal wall, which sometimes fails to close at birth. As the puppy grows, fatty tissue can protrude through the opening as a soft, rounded bulge under the skin. The abdominal wall will close by itself: usually by the time the puppy is 3 to 4 months of age. There is no reduction in purchase price for a Cavalier puppy with an umbilical hernia.

 

 

Returns:
 

Seller will consider a replacement puppy only if the conditions detailed in the “Health” section are met. If there is a problem upon arrival, the puppy has not visited the veterinarian as agreed, within the 72 hour time frame, and seller immediately following exam has not received the Vet Exam report, NO exchange will be considered. NO CASH REFUNDS.

1. To return a puppy, notify us by phone prior to return. The original veterinarian report and registration papers must be presented with the puppy if they were received at the time of purchase.

2. Buyer will be given a replacement puppy of comparable size and value. (If replacement puppy is not available at this time, Buyer will be given a voucher for puppy and notified IMMEDIATELY when comparable puppy is available.) ALL exchanges are limited to puppy of the same value or purchase price of the puppy. NO CASH REFUNDS.

or neglect is found to play a role in the demise of the puppy in any manner or fashion, then no exchange will be forthcoming. Additionally, Buyer agrees to hold seller harmless for such. Puppies are not exchanged for any reason.

1. Again, the seller assumes no responsibility of this puppy after leaving the premises, medical expenses, mortality, landlord’s disapproval, and allergy to animals, disagreement of family, or any other reason. (NOTE: Any puppy going to a new home may be unsure of him or herself until he or she becomes completely familiar with his or her surroundings, Therefore, upset stomach or diarrhea may occur.)

2. No guarantee is made as to disposition, conformation, or breeding ability. It is impossible to accurately determine the EXACT adult size of any puppy sold; therefore, we cannot give any size guarantee. Size is estimate is based on bloodline, age, and size of puppy at time of sale.

 

This agreement is made and entered into the State of Tennessee and shall be enforced and interpreted under the laws of this State.
